1) Who we are
The Scones Delivery (“we”, “our”, “us”) is an online marketplace that connects customers with independent food vendors (“Vendors”). The website at thesconesdelivery.co.za is operated by Symar Investments (Pty) Ltd, Reg. No. 2019/627492/07, trading as The Scones Delivery. 2) What we do (Marketplace role)

We provide the platform, payment facilitation and delivery.

Each Vendor is responsible for the baking, packaging, labelling, quality, allergen disclosures, and fulfilment of their products.

Your contract of sale is with the relevant Vendor. We may assist with customer service and refunds as set out below.
3) Products & availability

Images are for illustration; slight variations in colour, shape and size can occur because products are handmade.

Stock, lead times and delivery areas vary by Vendor and may change without notice.

We reserve the right to limit quantities, decline orders, or cancel for reasonable cause (e.g., mispricing, unavailable stock, suspected fraud).
4) Pricing & payment

Prices are shown in ZAR, inclusive/exclusive of VAT as indicated.

We use third-party, PCI-DSS compliant payment gateways. By paying, you also agree to their terms.

Orders are confirmed only once payment reflects as successful and written confirmation is provided.
5) Orders, delivery & collection

Delivery methods, fees, and time windows are displayed at checkout and depend on your address and Vendor availability.

Title and risk pass on delivery/collection. Please inspect parcels on receipt and report visible issues immediately.

If we cannot deliver within the indicated window, we’ll contact you to re-schedule or refund.
6) Perishable goods: returns, refunds & cancellations
Because baked goods are perishable, our policy balances food safety with customer satisfaction:
6.1 Quality issues

If your order arrives damaged, stale, or incorrect, notify us within 24 hours of delivery at info@theschoolplatform.co.za or whatsapp +27656555545 with your order number and photos.

Remedies may include replacement, partial/full refund, or store credit—at our discretion and subject to Vendor verification.
- Delivery fees are non refundable post delivery.
6.2 Change-of-mind

We generally cannot accept returns for change-of-mind on perishable goods once prepared or dispatched.

You may cancel before the Vendor begins baking/packing. Cut-off times are shown on the product page or at checkout.
6.3 Bulk & event orders
-
For 10L/20L sleeves or large events, cancellations must be made at least 72 hours before the agreed production start; otherwise reasonable costs may apply.
This policy operates alongside the Consumer Protection Act, 68 of 2008 (South Africa).
7) Allergens & dietary information

Typical ingredients include gluten, dairy, eggs; some items may be produced in facilities handling nuts/soy.

Allergen and ingredient information is supplied by Vendors. Always check the product page/label and contact us if you have questions before ordering.
8) Accounts & conduct
-
Keep your login secure; you’re responsible for all activity under your account.

Do not misuse the site (e.g., attempt to scrape, hack, or post unlawful content).
-
Reviews must be honest, respectful, and based on your own experience. We may moderate or remove reviews.
9) Vendor stores (summary of Vendor terms)
-
Vendors must list accurate prices, photos and ingredients; comply with food safety, labelling and licensing laws; fulfil orders as accepted; and handle post-sale queries promptly.

We may charge commissions, listing fees, and payout fees as agreed in the Vendor Dashboard or Vendor Agreement.

Payouts are made to Vendors on the schedule shown in the Dashboard, less fees, adjustments and chargebacks.

We may suspend or remove listings/stores that breach laws or our policies.

10) Promotions, vouchers & gift cards

Promo codes cannot be exchanged for cash and may carry expiry dates or product/area restrictions.

Only one code may be used per order unless stated otherwise.
11) Intellectual property

The website, logo, text, graphics and design are our IP or licensed to us.

You may not copy, reproduce or use our IP without written consent, except for normal browsing and purchasing.
12) Third-party services
We rely on payment processors, couriers, hosting, security and analytics providers. Their terms and privacy practices apply when you use those features.
13) Warranties & liability

The service is provided “as is”. To the maximum extent permitted by law, we exclude implied warranties not expressly stated here.

We are not liable for indirect or consequential loss, loss of profits, or any loss caused by events beyond our reasonable control.

Our total liability to you for any claim related to an order will not exceed the amount you paid for that order.
14) Indemnity
You indemnify us against losses arising from your unlawful use of the site, breach of these Terms, or infringement of third-party rights.

We process personal information in line with POPIA. See our Privacy Policy for details.
16) Changes to these Terms
We may update these Terms from time to time. The version posted on the website at the time of your order applies to that order.
17) Governing law & disputes
These Terms are governed by the laws of South Africa. If a dispute arises, please contact info@thesconesdelivery.co.za. If unresolved, you may pursue remedies available under South African law.
